This waiver and release of liability is executed on the date signed below by the undersigned participant (or legal guardian if under 18) (hereinafter “Participant”) in favor of 513Beach, Shoreline Social, and any other facility used for 513Beach events, including their directors, officers, employees, contractors, coaches, volunteers, agents, representatives, affiliates, successors, and assigns (collectively, “Released Parties”).
Acknowledgment and Assumption of Risk
Participant acknowledges that participation in beach volleyball training, practices, leagues, tournaments, and related physical activities organized by 513Beach involves inherent risks, including but not limited to: falls, collisions, overexertion, weather-related hazards, uneven playing surfaces, equipment failure, and interactions with other participants. Participant voluntarily assumes all such risks, known and unknown, even if arising from the negligence of the Released Parties.
Waiver and Release of Liability
In consideration for being permitted to participate in activities offered by 513Beach, Participant hereby fully and forever releases, waives, discharges, and covenants not to sue 513Beach, Shoreline Social, and any other facility used by 513Beach, along with all Released Parties, from any and all claims, demands, actions, or causes of action for personal injury, illness (including COVID-19), property damage, or death sustained by Participant whether caused by negligence or otherwise, arising out of or related to participation in any activity or event connected with 513Beach.
Medical Treatment Authorization
Participant authorizes 513Beach and its representatives to secure medical treatment for Participant in the event of an emergency and agrees to be financially responsible for any resulting medical costs.
Use of Likeness
Participant grants permission for 513Beach to use photographs and/or video recordings of Participant taken during activities for promotional, educational, and commercial purposes, without compensation.
Governing Law and Jurisdiction
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Ohio. Any legal action arising from this Agreement shall be brought in the courts of Hamilton County, Ohio.
Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remainder shall remain in full force and effect.
