PARTICIPATION WAIVER WAIVER OF LIABILITY, COVENANT NOT TO SUE, ASSUMPTION OF RISK / RELEASE / IMAGE RELEASE

PLEASE READ CAREFULLY

I, the undersigned, hereby acknowledge that participation in athletic activities involves an inherent risk of physical injury. The undersigned hereby agrees, for the sole consideration of West Hollywood Dodgeball and PopSports LLC, allowing the undersigned to participate in athletic activities for which or in connection with the league sponsored or made available any equipment, facilities, grounds, or personnel for such activities or to the undersigned while participating in any such programs or activities, the undersigned does hereby release and forever discharge West Hollywood Dodgeball & PopSports LLC, its members officially and individually, and its officers, agents, and employees of any and all claims, demands, rights, and causes of action of whatever kind or nature, arising from any injuries, damage to property, and the consequences thereof, including death, resulting from my participation in any way connected with such athletic activities. Further, in consideration of being allowed to participate in a dodgeball league and/or any other related events and activities produced by West Hollywood Dodgeball & PopSports LLC, the undersigned:

1) Acknowledges the risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
2) KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3) Willingly agrees to comply with the stated and customary terms and conditions for participation. If, however, the undersigned observes any unusual significant hazard during my presence or participation, he or she will remove themself from participation and bring such to the attention of the nearest official immediately.
Furthermore, I do herby consent to the use of my image or likeness in any manner of media without notifying me, such as web use, promotional materials, publications and any other non-official use.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
