Ascent Athletics Risk and Liability Waiver 

Waiver and Release of Liability, Assumption Of Risk, And Indemnity Agreement. In consideration of participating at Ascent Athletics llc., I represent that I understand the nature of this activity and that I am qualified in good health, in proper physical condition to participate in such activities. Tumbling, Trampoline, Double-Mini, and any gymnastic, Cheerleading, Dance, flying in the air comes at great risk including major injuries and even death. I acknowledge that if I believe events or physical conditions are unsafe, I will immediately discontinue participation in activity. I fully understand that this activity involves risk of serious bodily injury, including permanent disability, paralysis; which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of Ascent Athletics it coaches or staff and that there may be other risk either not know to me or not readily foreseeable at this time; and I fully accept and assume all such risk and all responsibility of losses, cost, and damages I incur as a result of my participation in the activity. I hereby release, discharge, and covenant not to sue Ascent Athletics llc., and its respective employees, administrators, directors, agents, officers, volunteers, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises (Ascent Athletics LLC/Employees Coaches and herein) on which the activity takes place. You release all above from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or impart by the negligence of any of those stated above working for or those helping in Ascent Athletics or otherwise including negligent rescue operations and further agree that if, despite this waiver and release of liability, and assumption of risk, I or anyone on my behalf, makes a claim against any of the Ascent Athletics LLC, Coaches, Employee or Volunteers, I will indemnify, save, and hold harmless each of the releasees from any loss, liability, damage, or cost, which may incur as the result of such a claim. I have read the waiver and release of liability, assumption of risk, and indemnity agreement, understand that I haven given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release off all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full effect. 

1. I expressly agree and promise to accept and assume all of the risk existing in these activities both known and unknown, whether caused or alleged to be caused by the ordinary, gross negligent acts of omissions of Ascent Athletics llc or it’s releasees. My participation in these activities is purely voluntary, and I elect to participate in these activities in spite of the risks.
2. I hereby voluntarily release, forever discharge, and  indemnify and hold harmless Ascent Athletics llc and it’s releasees from all claims, demands, or causes of actin which are in any way connected with my participation in these activities or my use of the Ascent Athletics gym and equipment or facilities, including any such claims which I, my children, parents, heirs, assigns, personal representative and estate have or may have that allege ordinary negligent acts or omissions of Ascent Athletics llc gym and releasees. I understand that this release includes all claims against Ascent Athletics entirely arising from its ordinary or gross negligence. 
3. Should anyone, its releasees, anyone acting on behalf of Ascent Athletics be required to incur attorney fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs to enforce this agreement. 
4. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in the activities, or else I agree to bear the cost of such injury or damage myself. I further certify that I have no medical or physical condition which could interfere with my safety while participating in these activities, or else I am willing to assume, and bear the cost of, all risks that may be created, directly or indirectly, by any such condition. 
5. I agree that the validity and enforceability of this release of liability and assumption of risk will be governed by the substantive law of Nevada, without regard to its conflict of law rules. 
6. I agree to abide by the rules of the facility. By signing this document, I acknowledge that if anyone is hurt or property is damaged, or equipment malfunctioned or worked incorrectly during my participation in these activities, I waive my right to hold liable or maintain a lawsuit against Ascent Athletics llc or it’s releasees for any claim by signing this document. 

Parental Consent- I, the minor’s parent and/or legal guardian, understand the nature of the above-reference activities and minor’s experiences and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge, covenant not sue and agree to indemnify and hold harmless each of the releasees from all liability, claims, demands, losses or damages on the minors account caused or alleged to have been cause in whole or in part by negligence of the releases or otherwise, including negligent rescue operations, and further agree that if despite this release I hold harmless each of the releasees from any litigation expenses, attorney fees, loss liability, damage, or cost any releasee may incur as the result of such claim. You also consent that you have explained the dangers and risk to your child of this sport. We are certified In Safe sport and follow those regulations.

Bullying and Prevention - At no time is your child allowed to bully or threaten another child at Ascent Athletics. In the gym or attending Gym outside activities that are regulated as part of a gym event. Bullying or threatening of a child in gym, at event, or Online social media. We have a NO TOLERANCE policy on bullying. You will be asked to leave the gym. Paying required fees if balance still exists. And asked to not return. 

Consent of Treatment of Minor- Should it be necessary, in the opinion of staff members of Ascent Athletics to render first aid and assistance to the participant(s) listed above, I hereby grant permission to the staff or any rescue/medical personnel that comes into Ascent Athletics to render such aid and assistance as they may deem necessary. I have carefully read this consent for treatment of a minor and fully understand its contents.

Photos/Videos/Media Release- All students and parents who participate in Ascent Athletics LLC. may have photography or video captured of them to use in all media forms such as but, not limited to: Social Media, Television, Radio, Printed Media, or any advertising and marketing purposes.

Payments, Electronic or Cash and Communication Agreement- When signing up for Ascent Athletics we use email, Square and other Electronic payment processing systems. You consent to your credit card being charged and information being stored. Your information is used for payment information only. Along with email communication, Phone Calls, Text you consent to receiving communication from Ascent Athletics. Your phone number and email will be used to make your payments and marketing only with Ascent Athletics. Once a payment is made there are no refunds. You are contracted for the month 30/31 days. 

In consideration of my membership in Ascent Athletics, and my participation in Ascent Athletics classes, events and activities, in or outside gym considered a mobile activity or event. You can't hold Ascent Athletics or Employees as stated above for participating in activities associated with Ascent Athletics that happen outside gym. Such as but not limited to activities such as festivals, parades, and competition meets. I agree to be bound by each of the following: Eligibility: I agree to comply with the rules of Ascent Athletics gym and staff. Readiness to Participate: I will only participate in those Ascent Athletics classes, events, and competitions, and activities for which I believe I am physically and psychologically prepared. Prior to participation, I will have stretched and warmed up to practice my exercises and will perform only those skills which I have accomplished to the degree of confidence necessary to assure I can perform by myself, and without injury. Medical attention: I hereby give my consent to Ascent Athletics LLC gym and Staff, plus all outside medical personnel, Host organizations to provide first aid, medical attention, transportation and emergency medical services as warranted in the course of my participation. Waiver and Release, I am fully aware and appreciate the risk, including the risk of catastrophic injury, paralysis, and event death, as well as other damages and losses associated with participation in Tumbling, Gymnastics, Dance, Cheer, Flying, Trampolines and other other sports that continue under the Gymnastic or artistic art umbrella activities or events. I further agree that the Ascent Athletics and the sponsor of any Ascent Athletics events, along with employees and releasees, agents, officers, directors, owners, organizations shall not be liable for any losses or damages occurring as a result of my participation in any event with Tulbing boulders.
