Fall Creek Kickball League Waiver of Liability

IN ORDER TO PARTICIPATE IN ANY WAY IN THE FALL CREEK KICKBALL LEAGUE (FCKL) AND RELATED ACTIVITIES, I THE UNDERSIGNED AGREE TO THE FOLLOWING:

1 - I understand that I am participating in an athletic, social, and/or sports activity that involves risk of illness, serious injury, including risk of permanent disability and death, and severe social and economic losses which might result not only from my own actions or negligence, but the rules of play, the actions of others, and the condition of the premises or any equipment used during such activities.

2 - I assume all risk and accept personal responsibility for the damages following such injury, illness, permanent disability or death.

3 - I will inspect the premises and/or equipment being used for such activities, and if I believe anything is unsafe, I will immediately inform or advise league personnel and refuse to participate.

4 - I release from liability the Fall Creek Kickball League (FCKL) and all affiliated clubs, teams, associations, persons, administrators, directors, agents, coaches, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used to conduct the activities, all of which are hereinafter referred to as “r e l e a s e s” from demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise.

5 - No participant is required to consume alcoholic beverages to engage in kickball. FCKL's sponsors and advertisers do not encourage or condone excessive drinking or intoxication in violation of the law. Individual participants are solely responsible for knowing and complying with applicable laws, including those related to alcohol consumption in public and driving under the influence or while intoxicated. FCKL does not assume any responsibility for any damages, liabilities, losses, or expenses incurred as a result of the consumption of alcohol at any point before, during, or after the games. FCKL is not responsible for monitoring or controlling the consumption of alcohol at any point before, during, or after games.

6 - I certify that all information I have provided here is accurate and that I fully understand all information presented.
