*RELEASE AND WAIVER OF LIABILITY, CUSTOMER AGREEMENT *
In consideration of The Little Red Schoolhouse contracting Flip Groove Play, LLC. (Vendor) to provide gymnastics instruction to enrolled students and in further consideration of my Childs participation in such activities.
I, the undersigned, for myself and/or on behalf of my minor child/ward, hereby acknowledge, agree, and represent the following:
Acknowledgment of Risks: I (Participant/Customer) understand and acknowledge that participation in gymnastics involves inherent risks, including but not limited to, the risk of serious injury, illness, or death. These risks may result from the actions, inactions, or negligence of myself and others, including Flip Grove, Play, its owners, employees, agents, and representatives, as well as the condition of the facilities and equipment.
Assumption of Risk: I (Participant/Customer) voluntarily and willingly assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by myself or my minor child/ward as a result of participation in gymnastics activities at Flip Grove, Play.
Release and Waiver: I (Participant/Customer) hereby release, waive, discharge, and covenant not to sue Flip Grove, Play, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by myself or my minor child/ward, or to any property belonging to me, while participating in gymnastics activities or while on the premises of Flip Grove, Play or where such activities are conducted of Flip Grove, Play.
Indemnity: I (Participant/Customer) agree to indemnify and hold harmless Flip Grove, Play, its owners, employees, agents, and representatives from any loss, liability, damage, or costs, including court costs and attorneys' fees, that they may incur due to my participation or my minor child/ward's participation in gymnastics activities.
Customer Agreement
This Gymnastics Training Agreement ("Agreement") is made and entered into as of the date signed below, by and between Flip Grove, Play ("Company") and the undersigned customer ("Customer").
Services Provided: The Company agrees to provide mobile gymnastics training and related activities to the Customer's child/ward ("Participant") at the location specified by the Customer.
Payment Terms
The Customer acknowledges that all tuition payments are non-refundable, as each enrollment reserves a limited space in the program. Tuition is processed automatically on the 25th of each month using the payment method on file.
If a payment is declined for any reason, the Company will notify the Customer by email and request updated payment information. The Customer is responsible for ensuring that a valid payment method remains on file. Participation in the program may be suspended until payment has been successfully processed.
Enrollment and Cancellation
Enrollment continues on a month-to-month basis until canceled by the Customer or the Company.
To discontinue enrollment, the Customer must provide written notice by email at least seven (7) days prior to the scheduled automatic payment date (the 25th of each month). Verbal notice, telephone calls, text messages, or notifications made through the school will not be accepted as official cancellation requests.
If written notice is not received by the required deadline, the scheduled automatic payment will be processed, and the tuition payment will be non-refundable.
The Company reserves the right to suspend or terminate participation immediately if the Customer or Participant fails to comply with the Company’s policies, engages in unsafe or disruptive behavior, or otherwise acts in a manner detrimental to the Company, its staff, or other participants.
Medical Consent: The Customer gives consent for emergency medical treatment to be administered to the Participant in the event of injury or illness during participation in mobile gymnastics activities provided by the Company.
Photo and Video Release: The Customer grants the Company permission to use photographs and/or video recordings of the Participant taken during mobile gymnastics activities for promotional purposes. If you wish to not provide consent, please send written declination.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action arising out of or relating to this Agreement shall be brought exclusively in the courts of the State of Florida.
Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
