Pickleball Tournament Waiver

LIABILITY WAIVER

In consideration of being permitted to participate in the Saratoga Schools Education Foundation Pickleball Tournament and related activities at the East Side Recreation Park in Saratoga Springs (collectively, the “Event”), I acknowledge and agree as follows:

Assumption of Risk. Participation in the Event carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary, but may include: (1) minor injuries such as bruises, sprains, and dehydration; (2) major injuries such as eye injuries, joint or back injuries, heat stroke, heart attacks, and concussions; and (3) catastrophic injuries, such as paralysis or death.

Release of Liability. I expressly waive and release any and all claims, now known or hereafter known, against the Saratoga Foundation for Innovative Learning, Inc., the City of Saratoga Springs, the Saratoga Springs City School District, and their respective trustees, directors, officers, tournament committee personnel, volunteers, members, and agents (collectively, the “Released Parties”) on account of personal injury, illness (including Covid-19), disability, death, property damage or loss, or financial loss arising out of, or related to, my participation in the Event, whether arising out of the ordinary negligence of a Released Party or otherwise. I agree not to make or bring any claim against a Released Party arising out of or related to my participation in the Event, and I forever release and discharge the Released Parties from liability under such claims.

Indemnification and Hold Harmless. I agree to indemnify and hold the Saratoga Foundation of Innovative Learning, Inc. and all other Released Parties named above harmless against any and all claims, actions, suits, damages, liabilities, losses, and expenses, including attorneys’ fees, brought as a result of my involvement in the Event.

Acknowledgment. I HAVE READ THIS LIABILITY WAIVER AND UNDERSTAND ITS TERMS AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES.
