Minnesota Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement

1. Acknowledgment of Inherent Risk

I understand that fencing is a combat sport and involves inherent risks of injury. These risks include, but are not limited to:

• Cuts, punctures, bruises, and lacerations
• Sprains, strains, dislocations, and fractures
• Head injuries and concussion
• Equipment malfunction or failure
• Falls, collisions, and contact with other participants
• Serious injury, permanent disability, or death

I understand that protective equipment reduces but does not eliminate risk.

I voluntarily choose to participate, or allow my minor child to participate, in fencing activities conducted by South Youth Fencing Alliance.

2. Express Assumption of Risk

I knowingly and freely assume all risks, both known and unknown, associated with participation in fencing activities, including risks arising from the ordinary negligence of SYFA, Sacred Writes LLC, its owners, coaches, employees, volunteers, referees, agents, and facility providers.

I understand that fencing involves close physical engagement and weapon use and accept those risks fully.

3. Release of Liability for Negligence

To the fullest extent permitted under Minnesota law, I hereby release, waive, and discharge South Youth Fencing Alliance (SYFA), Sacred Writes LLC, its owners, coaches, employees, volunteers, referees, agents, USA Fencing affiliates, and facility providers from any and all claims, demands, causes of action, damages, or liability arising out of or related to participation in fencing activities, including claims arising from the ordinary negligence of the released parties.

This release does not apply to gross negligence or intentional misconduct, which cannot be waived under Minnesota law.

4. Indemnification and Hold Harmless

I agree to indemnify, defend, and hold harmless SYFA, Sacred Writes LLC, its owners, coaches, volunteers, and facility providers from any claims, demands, losses, or liabilities arising from my participation, or my minor child’s participation, including any claim brought by or on behalf of the participant.

5. Medical Certification and Emergency Consent

I certify that I, or my minor child, am physically capable of participating in fencing activities.

I authorize SYFA personnel to obtain emergency medical care if deemed necessary. I understand that I am solely responsible for all medical expenses incurred.

6. USA Fencing and SafeSport Compliance

SYFA operates in alignment with USA Fencing rules and safety standards. Participants agree to follow all posted safety rules, codes of conduct, and referee instructions.

All coaching staff comply with required background screening and SafeSport training.

7. Equipment and Facility Acknowledgment

Participants agree to:

• Use fencing equipment properly and as instructed
• Report damaged equipment immediately
• Follow all strip, scoring apparatus, and facility safety rules

I understand that fencing involves use of electrical scoring equipment, reels, metal strips, and other apparatus that may pose risk if misused.

8. Photo and Media Release

I grant permission for SYFA to photograph or record participants during practices or competitions and to use such images for promotional, educational, or social media purposes without compensation.

9. Governing Law and Venue

This agreement shall be governed by and interpreted under the laws of the State of Minnesota.

Any legal action arising from participation in SYFA activities shall be brought exclusively in a court of competent jurisdiction located in Olmsted County, Minnesota.

10. Severability

If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

By completing registration through Playpass, I acknowledge that I have read, understand, and voluntarily agree to this Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement.
